TALCUM POWDER LAWSUIT ATTORNEYS

ASBESTOS-CONTAINING TALC POWDER LINKED TO OVARIAN CANCER

Johnson & Johnson’s talcum powder is a soft, dry powder designed to absorb moisture off of the skin, cause less friction in sensitive areas, and be soft, gentle, and hypoallergenic. The powder is used worldwide to help keep babies’ and children’s skin soft, smooth, and irritation free. However, in recent years, numerous studies have found traces of asbestos in J&J’s talcum powder and other talc-containing products. Asbestos is known to cause various forms of cancer, including ovarian cancer.

If you, your child, or your loved one was diagnosed with cancer or another asbestos-related illness after using talcum powder, including J&J’s baby powder products, you could be entitled to compensation—and Potts Law Firm can help. Our talcum powder lawsuit lawyers have helped numerous clients in both individual-plaintiff and mass litigation claims. We have the experience, resources, and skills to aggressively pursue maximum compensation on your behalf, and we are ready to fight for you and your rights throughout the legal process.

THE DANGERS OF TALCUM POWDER

Talc is a naturally occurring mineral and, on its own, it is not inherently dangerous. However, some talc contains asbestos and, in recent years, traces of asbestos have been detected in many talc-containing products, including Johnson & Johnson’s popular baby powder and personal hygiene products.

Asbestos is another naturally occurring mineral—but unlike talc, it is extremely dangerous to humans. For more than a century, asbestos has been known to cause various health conditions and potentially deadly illnesses, such as asbestosis, respiratory illness, mesothelioma, and other forms of cancer.

CURRENT TALCUM POWDER LAWSUITS

The trace amounts of asbestos in certain talcum powder products has put consumers at serious risk. As of July 2022, nearly 38,000 claims have been filed against Johnson & Johnson for injuries and damages resulting from exposure to asbestos in the company’s baby powder and other talc-containing products.

J&J, meanwhile, has agreed to pay approximately $4 billion in settlements and verdicts and has removed talc-based baby powder products from shelves in both the U.S. and Canada. Additionally, in August 2022, the company announced that it would no longer sell talc-based products beginning in 2023.

WHO CAN FILE A TALCUM POWDER LAWSUIT?

You may have grounds for a talcum powder lawsuit if you were diagnosed with ovarian cancer or another asbestos-related cancer or illness after using talc-containing products.

Specifically, if you were diagnosed with ovarian cancer, you must prove the following:

  • You used the talc-containing product extensively (daily or almost daily for about four years or longer) around the genital area (applied to the skin, sanitary napkins, diaphragms, etc.)
  • You were diagnosed with ovarian cancer between the ages of 22 and 65
  • You were diagnosed with ovarian cancer after the year 2000

If you were diagnosed with mesothelioma after using talcum powder, you could have a valid claim whether you used talcum powder for personal hygiene and/or cosmetic purposes (e.g., baby powder) or industrial-related purposes. Exposure to industrial-grade talc products—such as paint, clay, adhesives, and more—has been linked to mesothelioma and other asbestos-related illnesses.

DAMAGES AVAILABLE IN TALCUM POWDER LAWSUITS

Victims of dangerous products, such as asbestos-containing talcum powder, have the right to take legal action against the manufacturers, distributors, and others responsible for producing and selling those products. By filing a claim, you can seek financial restitution for the various physical, emotional, and financial losses you and your family have endured.

Depending on the specific details of your case, you may be entitled to the following damages:

  • Past, current, and future medical expenses
  • Lost or diminished earning ability
  • Miscellaneous out-of-pocket expenses related to your injury, illness, or losses
  • Wrongful death damages, such as funeral costs, lost inheritance, and loss of love, companionship, counsel, and support
  • Past, current, and future lost income/wages
  • Lost or diminished quality/enjoyment of life
  • Past, current, and future pain and suffering
