What Is a Dangerous or Defective Product?
A dangerous product is one that poses some risk of injury or harm to the user. A defective product is one that poses an unreasonable risk of injury or harm to the user. In other words, if the risks outweigh the benefits, or if a product does not work as intended, it is likely considered “defective.”
When a product is defective, and it causes harm, the party responsible for manufacturing or selling the defective product can be held liable for victims’ resulting damages in personal injury or product liability litigation.
To prove a defective product claim, you must prove each of the following:
- You were injured, and your injury led to measurable damages
- You were injured by a product that contained some defect or flaw
- The product’s defect or flaw was the proximate cause of your injury
- You were using the product correctly and as intended
- The product had not been modified from its original form
While some product liability cases fall under strict liability, most involve negligence. This means that you will likely need to prove how the manufacturer or another party’s negligence caused or contributed to the incident that led to your injury.
Three Types of Product Defects
While products can contain any number of flaws, all of which can render them unreasonably unsafe for normal consumer use, there are three main types of product defects.
These include:
- Design defects, which affect the actual design of the product and, therefore, entire lines
- Manufacturing defects, which occur during product and affect only certain units
- Labeling or marketing defects, which refer to missing or incomplete information needed for the safe use of a product, as well as misleading or false advertising
Determining what type of defect a product had is important, as it often indicates who is liable for your damages. At Potts Law Firm, our New Orleans product liability lawyers conduct independent investigations and work with leading industry experts to obtain critical evidence in support of our clients’ claims. We can help you not only identify the type of defect the product that caused your injury contained but also who is responsible for your resulting losses.
