Filing a Sexual Assault Injury Claim
A sexual assault injury claim is a civil case, as opposed to a criminal one. When someone is convicted of the crime of sexual assault, they face certain criminal penalties, such as steep fines and jail or prison time. A civil case, on the other hand, allows the affected party or parties to seek financial restitution for the economic and noneconomic losses (or “damages”) they have endured as a result of the assault.
Examples of damages in sexual assault injury claims include:
- Medical expenses
- Therapy/counseling costs
- Financial losses
- Loss of income or wages
- Post-traumatic stress disorder (PTSD)
- Pain and suffering
- Emotional distress
- Punitive, or exemplary, damages
- Attorney fees and court costs
- Medical expenses associated with treating mental health conditions, including medication costs
- Depression, anxiety, and other new or worsened mental health conditions
It is important that you work with a knowledgeable legal team that can guide you through this process and ensure your rights are protected. At Potts Law Firm, our New Orleans sexual assault attorneys are prepared to stand up for you and serve as your voice.

Like other states, Louisiana has specified deadlines, known as statutes of limitations, for filing sexual assault injury claims. In most personal injury cases, the victim has one year to file a lawsuit in Louisiana courts. However, in cases involving sexual abuse or assault, the state provides survivors the right to sue up to three years after the date on which the abuse or assault occurred or up to three years after the date on which the survivor is informed of the perpetrator’s identity by law enforcement or a judicial agency.
Additionally, there may be certain extenuating circumstances which allow a sexual assault survivor to bring a lawsuit against a liable party if more than three years have passed. For example, in some cases involving sexual abuse of a minor, the survivor can file a sexual abuse injury lawsuit up to 10 years after their 18th birthday.
However, it is generally better to act sooner rather than later. We encourage you to reach out to our team at Potts Law Firm right away to learn how we can assist you in seeking the justice you deserve.
