How Long Do You Have to File a Sexual Assault Injury Claim?

Like other states, Louisiana has specified deadlines, known as statutes of limitations, for filing sexual assault injury claims. In most personal injury cases, the victim has one year to file a lawsuit in Louisiana courts. However, in cases involving sexual abuse or assault, the state provides survivors the right to sue up to three years after the date on which the abuse or assault occurred or up to three years after the date on which the survivor is informed of the perpetrator’s identity by law enforcement or a judicial agency.

Additionally, there may be certain extenuating circumstances which allow a sexual assault survivor to bring a lawsuit against a liable party if more than three years have passed. For example, in some cases involving sexual abuse of a minor, the survivor can file a sexual abuse injury lawsuit up to 10 years after their 18th birthday.
